If the “points account” of a driver in the Flensburg sinner register exceeds 18 or more, the driver's license must be withdrawn. The law assumes that many traffic offenses are unsuitable for driving a motor vehicle. If an advanced seminar is attended in the meantime, the number of points is reduced so that the 18-point mark may not be reached. However, it does not depend on the number of points that was decisive in the final punishment of the last traffic violation, but on the status on the «day of the act».
Too late dismantling seminar
The Federal Administrative Court (Az.: 3 C 3/07) came to this result, which is negative for motorists. Since this date is naturally before the legally binding decision, drivers cannot quickly try to reduce their points account between the first and the last day by means of an advanced seminar. If the 18-point limit is reached on the day of the traffic offense, then the driver's license is gone. (AG)
