The codetermination dispute goes into the next round. But even after the meeting before the Stuttgart Labor Court, a decision is not expected.
The process in the codetermination dispute between the VW works council and Porsche began on Tuesday at the Stuttgart Labor Court. VW works council chief Bernd Osterloh wants to overturn the co-determination agreement of Porsche Holding because, in his opinion, it is at the expense of the VW workforce. The paper stipulates that the 12,000 employees of the sports car manufacturer in the new holding company have the same rights as the 360,000 or so VW employees in important matters. Even after the court decision, an end to the power struggle is not expected, instead a long legal tug-of-war is expected by the authorities.
Osterloh not present
At the start of the proceedings, to which Osterloh did not appear, both sides insisted on their positions. The legal advisor to the VW works council argued that the Stuttgart-based company already controls VW and that the VW works council should therefore have been involved in the negotiations on the co-determination agreement. There are already corporate law influences and personal ties.
The lawyers from Porsche, however, said that the sports car manufacturer only holds 31 percent of the shares in Wolfsburg. The basis for control is the right to vote, which must extend over a longer period of time. The demand is therefore unfounded. Works council chief Uwe Hück and CFO Holger Härter came to the negotiation for Porsche.
Three seats each planned
The co-determination agreement was negotiated by the Porsche management with Wendelin Wiedeking at the top, his works council chief and IG Metall. Porsche plans to take over the majority of Europe's largest car company. The operating business of the sports car manufacturer and, after the expansion of the VW shares to over 50 percent, the subsidiary Volkswagen are to be managed in the holding company. The holding company's supervisory board has three works council seats each for Porsche and VW. (dpa)
