Traffic offenders may apply for a new driver's license abroad after their blocking period has expired. According to a judgment, the new driving license must also be recognized in Germany.
German traffic offenders may, under certain conditions, acquire a new driver's license abroad. The German authorities would have to recognize driving licenses legally issued in EU countries, the European Court of Justice (ECJ) ruled in a judgment published in Luxembourg on Monday. A Bavarian had sued who had lost his German driver's license and obtained a new driver's license in Austria after the imposed blocking period had expired.
Driving license must be recognized
Daniel Halbritter got a new driver's license at his residence in Austria in 2002. At this point the blocking period of 18 months imposed on him in Germany in 1996 had already expired. In 2003, the Munich district office refused to convert the Austrian driver's license into a German one. Reason: A medical-psychological examination - the so-called idiot test - is necessary. The ECJ rejected this justification of the authority in its judgment (case C-227/05).
According to European law, a member state must recognize a driver's license from another EU country if a traffic offender has acquired it after the blocking period has expired, the judges said. And in a situation like in the decided case, the driving license must also be rewritten.
Unification comes in 2012
At the end of March, the transport ministers of the 25 EU countries decided to introduce a uniform EU driving license. This should make it more difficult for traffic offenders to obtain a replacement for confiscated driving licenses in other EU countries. From 2012 onwards, the authorities should exchange their data on such cases across borders.
