A car insurance does not have to cover accident damage for a tuned car. This also applies if the technical changes were not the trigger for the crash.

If you tune your car, you risk your fully comprehensive insurance in the event of an accident. This applies even if the technical changes were not the cause of the accident. According to a ruling by the Koblenz Higher Regional Court, it is sufficient that tuning induces risky driving behavior (Az.: 10 U 56/06). The German Lawyers Association (DAV) in Berlin refers to the judgment.

The risk of accidents is significantly increased

In that case, according to the DAV, the plaintiff had changed the tires and axles of his car and increased the engine power. He left the car to his son, who was taking a ride with a friend. After both had drunk the friend drove on. Applying the handbrake while driving caused a serious accident in which the friend died. With reference to the tuning, the fully comprehensive insurance refused to take over the damage.

The court agreed with the company. The tuning increased the risk of such an accident. The sole purpose of the technical changes to the car was to make the car sportier and faster, according to the judges' statement. This affects the driving behavior. A tuned car creates a special incentive for young drivers in particular to drive more riskily. This is also proven by the fact that the two occupants drove far too fast under the influence of alcohol - 100 to 130 km / h instead of the permitted 70 km / h. Therefore, the insurance does not have to pay. (dpa)
