The professional cooperative is not obliged to pay in the event of a negligent accident. Pension payments can also be refused if the accident happens on the way to work.
Anyone who causes an accident through daring behavior on the way to their job is not entitled to a cash pension from the employers' liability insurance association. This is announced by the Oldenburg Bar Association with reference to a judgment by the Federal Social Court (Az.: B 2 U 1/07). According to this, the cooperative may withhold the benefits of the statutory accident insurance in whole or in part if the accident at work occurs during a criminal offense. Such was the case.
Overtaken in right-hand bend
On the way to his internship, a man overtook a column of vehicles in front of a hilltop and a right-hand bend. He collided with an oncoming vehicle, the driver of which was injured. The local court sentenced the driver, among other things, for deliberate traffic hazard. The trade association recognized the accident as a road accident.
