A car driver was very unlucky when he slammed a barrier on his car in a shopping mall. And a stinking rage at the cyclist who rolled over the induction loop directly in front of him.

Bad luck: when a driver wanted to leave the parking lot of a Munich shopping center and the barrier opened, a cyclist drove past the car and under the barrier. The driver followed the cyclist, who had already passed the second induction loop - the barrier closed and slammed onto the car. The car owner sued those responsible for the parking area for 1235 euros in damages. The Munich District Court dismissed the lawsuit and denied any liability. It is not necessary to take precautions for all accident eventualities, it said in the judgment published on Monday. The judgment is final.

A traffic safety system, which excludes any accident, is not available, the court found (Az.: 223 C 27796/07). Failures on the part of those responsible for the park are not recognizable. Immediately in front of the barrier is a yellow sign with the inscription: "Attention, the barrier closes automatically after each passage." Other signs indicate that cyclists and pedestrians should share the pavement of the park area. Those responsible for the park could not prevent individual cyclists from not using the sidewalk. (dpa)
