Damaged persons are entitled to reimbursement of costs from a brand-specific workshop after an accident. The amount of the costs compared to an independent workshop is irrelevant.
After a car accident, injured parties do not have to be satisfied with repairs in an independent workshop. You are entitled to reimbursement of the costs of a branded workshop. This is announced by the German Lawyers' Association (DAV) in Berlin, citing a judgment by the Dortmund Regional Court (Az.: 17 S 68/08). In the negotiated case, it was about the fact that an insurance company considered the hourly rate of a branded workshop for wage costs specified in an expert report to be too high - and refused the reimbursement.
Law in the second instance
In the second instance, however, the judges ruled that the injured party had the right to charge the hourly wages of a branded workshop in the event of an accident. It was also pointed out that a car owner could not know without extensive research whether the independent workshop had the same experience with the vehicle or the brand as the brand-specific specialist workshop.
