A community is complicit when motorists suffer damage from potholes. This emerges from a decision of the Higher Regional Court of Celle (Az.: 8 U 199/06). In the negotiated case, a large city had to pay damages to a motorist after he drove into a 20 centimeter deep pothole on a busy thoroughfare. A tire was damaged and two rims broke.

Drivers have to pay half

Although the municipality had ordered 30 km / h in front of the accident site and warned of road damage on signs, the judges agreed with the driver. But the man had to bear half of the costs of around 2800 euros himself. As a rule, drivers are partly to blame in such cases, explain the lawyers. The reason is that the general visual driving requirement obliges drivers to only drive so fast that it is possible to stop in front of obstacles at any time. (Dpa)
