A Herford judge acquitted all tempo offenders since last week. The traffic lawyer considers speed traps to be a rip-off and thus has a debate about the previous legislation.

With a series of acquittals for speeding sinners, a Herford judge sparked a debate about speed traps. Since last week, the traffic lawyer Helmut Knöner clears every speed offender because he considers many speed traps to be just money-making. "The risk of rip-offs is there," Knöner told the dpa news agency on Wednesday. The automobile club ADAC and traffic experts reacted skeptically. The German Bar Association gives Knöner right.

Judge acquits 42 speeders

The controversial magistrate from East Westphalia acquitted 42 flashed drivers last week - and that is just the beginning. The 62-year-old judge wants to leave the speeders unmolested until something changes in the legislation: "There are no binding rules as to when and where and with which devices flashes are made."

It is often unclear why speed traps are set up in some places. "The question of what motives is used for flashing has not yet been answered." Cities and municipalities earned a lot of money with the lightning systems. "Many feel the pressure of the empty coffers," said Knöner, who has been making his judgments at the local court for more than 30 years. In order to exclude tailoring money, however, it must be clearly regulated for what reasons speed traps are used. "There must be a control."

The German Lawyers Association (DAV) also believes that speed measuring systems are often installed for cashing in. "The systems are not set up where they could create the greatest traffic safety," said Jörg Elsner, the chairman of the DAV working group traffic law, the news agency dpa. "Instead, the measurements are made on four-lane arterial roads, because that's where you earn the most money."

ADAC is critical of the demands

The automobile club ADAC is critical of Knöner's demands: "If you ask the legislature to determine where and how measurements are taken, that is unreasonable," said ADAC's head of traffic law, Markus Schäpe, of the dpa. An announcement of speed cameras would be at the expense of security. Judge Knöner also criticizes the legal basis for photo or video recordings of tempo sinners. They are made on the basis of an anti-terrorism law, and that is wrong. The ADAC holds against it: "It is perfectly permissible to take photos if there is no other option."

The Bielefeld public prosecutor's office now wants to examine the mass acquittal and possibly lodge a legal complaint. "We did not know such a case," said a spokesman for the authorities. Experts do not believe that traffic offenders benefit from Knöner's judgments. The Cologne traffic lawyer Michael Bücken said: "Each judgment is an individual decision and does not give a reason for suspension for other administrative offense proceedings." Anyone who has been flashed and still has a bill must pay. (dpa)
