After a tire change, the workshop must inform the driver that he must retighten the wheel bolts. If she fails to do so and an accident occurs, compensation will be due.

It's that time again in October. Then summer tires should be swapped for winter tires. Shortly before the start of the tire change, there is an important judgment following an appeal by the Heidelberg Regional Court.

Wheel bolts must be tightened

It ruled that due to inadequate safety instructions after changing tires, a car workshop must pay the driver compensation after an accident. The court considered it proven that the workshop had not pointed out clearly enough that the wheel bolts of newly fitted winter tires had to be retightened after the first 100 kilometers. Only on the invoice below the signature line and without any special marking there was a reference to the obligation, as the court has now announced. The judgment had already been pronounced on July 27th (Az. 1 S 9/10).

A man had filed a lawsuit because he wanted the workshop to reimburse a loss of 4,000 euros. After driving around 1900 kilometers, a tire came off while driving on the motorway. The court has now found him right on appeal. However, the plaintiff is responsible for 25 percent because he must have noticed the gradual loosening and did not drive to the workshop in time. (dpa)
