Storing things in the car can be very expensive after they have been stolen, especially if you were the owner. The consequences of a key steal.
A tenant has to pay for the new locking system for a property himself if the keys are stolen from the car. Because tenants violate the so-called duty of care by storing them in the car. This emerges from a judgment of the Berlin Court of Appeal, to which the German Bar Association refers (Az.: 8 U 151/07). The duty of care obliges tenants, among other things, to protect the rented property from possible damage.
Principle of personal responsibility
In the negotiated case, a shop employee had parked his car on the street for a quarter of an hour. The car was broken into during this time and his notebook bag was stolen - the key to the operation was in this. As a tenant, the owner of the shop then asked the landlord to replace the entire locking system. The landlord followed this request. But he demanded the cost of 10,000 euros back from the tenant - and rightly so, as the court decided. (dpa / gms)
