Drivers should not park their vehicle in a guest car park outside of opening hours. Because if the vehicle is then towed, the towing costs have to be paid.

If you park your car in the guest parking lot of a restaurant outside of opening hours, you must expect it to be towed. This is reported by the specialist journal “NJW-Jurisdiction Report Civil Law” (Issue 13/2012), citing a ruling by the Lübeck District Court. According to the judgment of the judge, this also applies if the driver claims that he wanted to visit the restaurant later (Ref.: 33 C 3926/11).

Towing company must be paid

The court thus upheld a tow company's claim for payment. In that case, a driver parked his car in a restaurant outside opening hours.

The district court found that he should not have done this. The parking lot is clearly only reserved for guests during opening hours. Therefore, the argument that the driver wanted to visit the restaurant later is irrelevant in this case. The operator of the restaurant does not have to allow the car to be parked - he can have the car towed away. (dpa / tmn)
